Discern Corporation (collectively “Discern,” “Discern.io,” “we,” “our,” “us,”) owns and operates a public website (“Public Site”) as well as our hosted analytics products (“Products”), which are restricted to authorized users. Discern recognizes and respect the privacy of users who interact with us. Discern collects, uses and discloses Personal Information in a manner consistent with the applicable laws and regulations of the United States and other countries in which it does business. This Privacy Policy describes what information Discern collects when you interact with our products, how Discern uses, shares and protects that information, and how you can access and update it. It also applies to all personal information received by Discern in the United States from the European Economic Area (“EEA”) (which includes the Member States of the European Union (“EU”) plus Iceland, Liechtenstein and Norway) to the United States and from Switzerland to the United States in any format, including electronic, paper or oral. It is effective on the date below and applies to our use of your information on and after that date. This Privacy Policy provides notice to individuals regarding the collection, use, and disclosure of their personal information.

DEFINITIONS

For purposes of this Policy, the following definitions shall apply:

  • “Agent” means any third party that uses Personal Information provided by Discern to perform tasks on behalf of and under the instructions of Discern Corporation
  • “Discern” means Discern Corporation, its subsidiaries, divisions and groups in the United States of America.
  • “Personal Information” means any information or set of information that identifies or could be used by or on behalf of Discern to identify an individual. Personal information does not include information that is encoded, anonymized or aggregated, or publicly available information that has not been combined with non-public personal information.

COLLECTION OF PERSONAL INFORMATION

Discern collects information provided to us through our Public Site or our Products.

Public Site: In general, you can visit our Public Site without telling us who you are or revealing any information about yourself. Discern does not currently track and collect information about your browser, domain name, IP address and the web pages you visit. There may be areas on our Public Site where you may provide personal information to obtain information or access to Discern’s Products.

Products: Our Products assist Customers with CRM analytics and forecasting. Access to our Products is restricted to registered Customers with whom Discern has an ongoing contractual relationship and their designated authorized users. Information provided when a potential customer registers for any of our online services or uses our applications is personally identifiable. Customer and Discern enter into agreements that govern the use, confidentiality and security of the data. Depending on use cases, Personal Information may or may not be collected or processed.

PURPOSE AND USE OF PERSONAL INFORMATION

Discern may use Personal Information for operational, legal, administrative, and other legitimate purposes permitted by applicable law. Some of the ways we may use personal information include:

  • Providing you with requested products or services.
  • Providing you with information regarding similar products or events.
  • Analyzing and monitoring extent of use and enhancing Discern’s Products.
  • Providing customized product and service information.
  • Allowing users to participate voluntarily in mailings or other events.
  • Providing product service updates, information, and alerts.
  • Sending communications, including for marketing or other customer satisfaction purposes.
  • To contact users for information verification purposes.
  • Conducting due diligence activities for financial institutions and other regulated companies.

Discern only uses the data to support the business requirements of the Products, and Discern never shares your data with third parties other than as set out in this Privacy Policy.

CHILD PRIVACY

Because of the nature of our business, our products and services are not designed to appeal to minors, and therefore Discern does not knowingly attempt to solicit or receive any information from children under 16. If Discern is aware that information is being provided by a person under the age of 16 Discern will not collect the information.

DISCLOSING INFORMATION TO THIRD PARTIES

Discern does not disclose or share any Personal Information with third parties. Discern also may be required to disclose an individual’s Personal Information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

INTERNATIONAL SITE VISITORS

If you are visiting our Public Site from outside the United States, you expressly and affirmatively consent to transferring your Personal Information to Discern in the United States, where it will be maintained and processed on our servers. You acknowledge and agree that the level of data protection in the United States may not be equal to the level of protection under the laws of other countries.

The Personal Information submitted through the Public Site that is transferred to Discern in the United States will be used to respond to your requests for information.

The Personal Information submitted through our Products is transferred to Discern in the United States will be used to support the functions necessary to deliver our Products and services.

  • The right to access, correct, update, or request deletion of your personal information;
  • The right to object to the processing of your personal information by asking us to restrict processing of your personal information or request portability of your personal information; and

If personal information pertaining to you as an individual has been submitted to Discern by or on behalf of a Discern customer and you wish to exercise any data protection rights, you may have in respect of that data under applicable law please inquire with the relevant Discern customer directly. We have a limited ability to access customer content. However, if you wish to make your request directly to us, please provide the name of the Discern customer who submitted your data to our service. We will refer your request to that Discern customer and will support them as needed in responding to your request within a reasonable timeframe. OUR SECURITY MEASURES

Discern has physical, administrative, and technical safeguards in place to help protect the personal information Discern collects. While there is no such thing as perfect security on the Internet, we will take reasonable and appropriate steps to ensure the safety of your Personal Information.

While Discern takes steps to protect your Personal Information, you also play a role in protecting your information. You can help to maintain the security of your online transactions by not sharing your log-on information or password with anyone. If Discern receives instructions using your log-on information and password Discern will assume that the instructions have been authorized by you.

CHANGES TO THIS PRIVACY POLICY

Discern will occasionally amend this Privacy Policy to reflect company and customer feedback and Discern reserves the right to make changes to this Privacy Policy at any time. The use of your information is subject to the Privacy Policy and Terms of Use in effect at the time of use. The provisions contained in this Privacy Policy supersede all previous notices or policies regarding our privacy practices with respect to this site.
